2. Acceptance of Terms

Our Services are designed for individuals and organisations navigating pension entitlement, dispute resolution, and formal litigation before Thai courts and administrative tribunals.

The three principal service lines are as follows:

  • Pension Entitlement Review (฿1,800): A document-led examination of the client's pension position, covering contribution history and applicable schemes.
  • Pension Dispute Representation (฿8,400): Advocacy and representation in administrative reviews where pension awards have been disputed.
  • Court Proceedings for Pension Matters (฿10,500): Full representation in Labour Court and administrative tribunals, including pleadings, hearings, and appeals.

Service availability is subject to attorney capacity and the nature of the matter. We reserve the right to decline engagement where a conflict of interest or other professional consideration applies.

4. User Responsibilities

When using this website or engaging our Services, you agree to:

  • Provide accurate, complete, and truthful information at all times;
  • Cooperate fully with our attorneys and staff in the conduct of your matter;
  • Respond to requests for documents or information within reasonable timeframes;

6. Payment Terms

All fees are quoted and payable in Thai Baht (฿). Published prices represent our standard service fees and are correct at the time of display. Fees for individual matters may be confirmed in writing prior to engagement.

Payment is due in accordance with the terms set out in your engagement letter. We accept payment by bank transfer to our designated account. Further payment methods, if available, will be confirmed at the time of engagement.

Disbursements — such as court filing fees, translation costs, or third-party expenses — will be agreed in advance and are payable in addition to professional fees.

Enquiries submitted through this website do not constitute an engagement or a commitment to any fees. A formal engagement begins only upon the signing of a written engagement letter and the receipt of any agreed advance payment.

7. Service-Specific Terms

The following additional terms apply to each service:

Pension Entitlement Review

The review is based on documents provided by the client. Its scope is limited to the materials submitted and the applicable legal framework at the time of review. The written summary delivered at the conclusion of the review represents our professional assessment at that time; it does not constitute a legal opinion on which reliance should be placed without further consultation.

Pension Dispute Representation

Representation in administrative proceedings is subject to the procedural requirements of the relevant authority. Timelines are shaped by those authorities and may change. We will keep the client informed of developments at each material stage.

Court Proceedings

Court proceedings are subject to the procedural rules of the Labour Court and administrative tribunals of Thailand. The duration of litigation is outside our control. Full representation through hearings and any appeals is included within the agreed scope, subject to the terms of the engagement letter. Material changes in scope will be agreed in writing.

8. Confidentiality

All information disclosed to us in the course of an engagement is treated as strictly confidential. We will not disclose your information to third parties without your consent, except where required by law, a court order, or professional regulatory obligation.

We ask that you similarly treat as confidential any strategic advice, assessments, or correspondence provided by Suvarna Counsel in the conduct of your matter. Disclosure to uninvolved third parties may affect the legal protection afforded to such communications.

9. Disclaimers

Nothing in these terms excludes liability for fraud, wilful misconduct, or any matter where exclusion is not permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Suvarna Counsel, its attorneys, and staff against any claims, costs, or losses arising from your breach of these Terms and Conditions, your misuse of this website, or the provision of inaccurate or misleading information in connection with your matter.

12. Termination

Either party may bring an engagement to a close upon reasonable written notice. In such circumstances, the client remains responsible for fees incurred and disbursements made up to the date of termination.

Suvarna Counsel may withdraw from an engagement if required by professional ethics, a conflict of interest arises, or the client's instructions cannot reasonably be followed.

Provisions relating to confidentiality, intellectual property, payment, and limitation of liability shall survive the termination of any engagement.

13. Dispute Resolution & Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Thailand.

Before commencing formal proceedings, we encourage both parties to seek resolution through good-faith discussion. Should direct resolution prove unsuccessful, the parties may consider mediation as a first step.

14. General Provisions

  • Entire Agreement: These Terms and Conditions, together with any written engagement letter, constitute the entire agreement between the parties with respect to the subject matter hereof.
  • Severability: If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining terms will continue in full force.
  • Waiver: Failure to enforce any provision of these terms shall not constitute a waiver of the right to enforce it subsequently.
  • Assignment: You may not assign your rights or obligations under these terms without our prior written consent. We may assign our obligations in connection with a reorganisation of our practice, subject to adequate notice.

15. Changes to These Terms
